§ 1 General
We process your personal data, such as your name, email address, telephone number and address, only in
accordance with the provisions of German data protection law and the data protection law of the European Union
(EU). The following provisions inform you about the purposes of processing, recipients, legal bases and storage
periods, as well as about your rights and the controller responsible for processing your data. This privacy
policy applies only to our websites. If you are forwarded to other sites via links on our pages, please inform
yourself there about how your data is handled.
§ 2 Data processing for the performance of a contract
(1) Purpose of processing
The personal data you provide when contacting us is required for communication with us. You are not obliged to
contact us. Without your email address we cannot reply to you. If you send us an enquiry before concluding a
contract by email, via a contact form or similar, we process the data received in this way to carry out
pre-contractual measures and to answer, for example, your questions about our products.
(2) Legal basis
The legal basis for this processing is Art. 6 (1) (b) GDPR.
(3) Categories of recipients
Payment service providers, shipping service providers, hosting providers, where applicable merchandise management
system, where applicable suppliers (drop shipping).
(4) Storage period
We store the data required to process the contract until the statutory warranty periods and any contractual
guarantee periods have expired. We retain the data required under commercial and tax law for the periods
prescribed by law, usually ten years (cf. § 257 HGB, § 147 AO). Data processed to carry out pre-contractual
measures is deleted as soon as the measures have been carried out and it is evident that no contract will be
concluded.
§ 3 Customer account and use of the platform
(1) Purpose of processing
To use our platform for managing lift tables, maintenance and spare parts, you create a customer account or we
create it for you. In doing so, we process your name, your company, your email address and your password (stored
encrypted) and, where applicable, your telephone number, address and contact person. After registration we send
you an email with a confirmation link (double opt-in); your account is only active after confirmation. When you
use the platform, we process the data you enter about your lift tables and spare parts, the manuals you upload
and the maintenance data, inspection, repair and service documents created by us. We inform you by email about
relevant events, such as upcoming or overdue maintenance, new documents, the approval of your lift tables and low
spare part stock.
(2) Legal basis
The legal basis is Art. 6 (1) (b) GDPR, as the processing is necessary for providing our services and performing
the contract.
(3) Categories of recipients
Hosting providers, email delivery service providers and, for the automatic analysis of manuals, the provider named
in § 4.
(4) Storage period
We store the data of your customer account for as long as your account exists. When the account is deleted, we
also delete the associated lift tables, documents and spare parts, unless statutory retention obligations apply.
Registrations that are not confirmed within seven days are deleted automatically.
§ 4 AI-assisted analysis of manuals
(1) Purpose of processing
When creating a lift table, you can have the technical data read automatically from an uploaded manual (PDF). For
this purpose, we transmit only the PDF document you select to the interface of the AI service Claude of the
provider Anthropic PBC, 548 Market Street, PMB 90375, San Francisco, CA 94104, USA. The analysis only takes place
when you explicitly start it. The result is shown to you for review and is only saved after you have applied it to
the form. Please do not upload documents containing personal data for this function.
(2) Legal basis
The legal basis is Art. 6 (1) (b) GDPR, as the function is part of the service you use, and Art. 6 (1) (f) GDPR;
our legitimate interest lies in a simple and accurate recording of lift table data.
(3) Transfer to a third country
Processing by the provider may take place in the USA. The transfer is based on the standard contractual clauses
of the European Commission (Art. 46 (2) (c) GDPR). According to the provider, content transmitted via the
interface is not used to train its AI models.
(4) Storage period
The document transmitted for analysis is deleted on our side immediately after the analysis. The provider stores
the content only for the period required under its terms for operation and protection against misuse.
§ 5 Information about cookies
(1) Purpose of processing
This website only uses technically necessary cookies. The session cookie stores your session, for example the
selected language and, after logging in, your login to the customer area. The "XSRF-TOKEN" cookie protects
the forms (contact, login) against forged requests. If you select "Stay signed in" when logging in, an
additional cookie is set that recognises you on your next visit. We do not use cookies for analysis,
tracking or advertising purposes.
(2) Legal basis
The cookies are stored in your browser on the basis of § 25 (2) No. 2 TDDDG, as they are strictly necessary
for the operation of the website. The legal basis for the related processing is Art. 6 (1) (f) GDPR; our
legitimate interest lies in the secure and functional operation of the website. For logging in to the
customer area, the legal basis is Art. 6 (1) (b) GDPR.
(3) Storage period
The session cookie and the "XSRF-TOKEN" cookie become invalid after two hours of inactivity. The "Stay signed
in" cookie remains until you log out or delete it in your browser. You can delete cookies in your browser
settings at any time.
§ 6 Rights of the data subject
If your personal data is processed, you are a data subject within the meaning of the GDPR and you have the
following rights against the controller:
1. Right of access
You can ask the controller to confirm whether personal data concerning you is being processed by us. If such
processing takes place, you can request the following information from the controller: (1) the purposes for
which the personal data is processed; (2) the categories of personal data being processed; (3) the recipients or
categories of recipients to whom the personal data concerning you has been or will be disclosed; (4) the planned
duration of storage of the personal data concerning you or, if specific information on this is not possible, the
criteria for determining the storage period; (5) the existence of a right to rectification or erasure of the
personal data concerning you, a right to restriction of processing by the controller or a right to object to
such processing; (6) the existence of a right to lodge a complaint with a supervisory authority; (7) all
available information about the origin of the data if the personal data is not collected from the data subject;
(8) the existence of automated decision-making, including profiling, in accordance with Art. 22 (1) and (4) GDPR
and, at least in these cases, meaningful information about the logic involved as well as the significance and
the intended effects of such processing for the data subject. You have the right to request information as to
whether the personal data concerning you is transferred to a third country or to an international organisation.
In this context, you can request to be informed about the appropriate safeguards pursuant to Art. 46 GDPR in
connection with the transfer.
2. Right to rectification
You have a right to rectification and/or completion against the controller if the processed personal data
concerning you is incorrect or incomplete. The controller must carry out the rectification without delay.
3. Right to restriction of processing
You can request the restriction of the processing of personal data concerning you under the following
conditions: (1) if you contest the accuracy of the personal data concerning you for a period that enables the
controller to verify the accuracy of the personal data; (2) the processing is unlawful and you oppose the erasure
of the personal data and request the restriction of its use instead; (3) the controller no longer needs the
personal data for the purposes of processing, but you need it for the establishment, exercise or defence of legal
claims, or (4) if you have objected to the processing pursuant to Art. 21 (1) GDPR and it has not yet been
determined whether the legitimate grounds of the controller override your grounds. If the processing of personal
data concerning you has been restricted, this data may, apart from its storage, only be processed with your
consent or for the establishment, exercise or defence of legal claims or for the protection of the rights of
another natural or legal person or for reasons of important public interest of the Union or a Member State. If
the processing has been restricted under the above conditions, you will be informed by the controller before the
restriction is lifted.
4. Right to erasure
a) Obligation to erase
You can request the controller to erase the personal data concerning you without delay, and the controller is
obliged to erase this data without delay if one of the following reasons applies: (1) The personal data
concerning you is no longer necessary for the purposes for which it was collected or otherwise processed. (2) You
withdraw your consent on which the processing was based pursuant to Art. 6 (1) (a) or Art. 9 (2) (a) GDPR and
there is no other legal basis for the processing. (3) You object to the processing pursuant to Art. 21 (1) GDPR
and there are no overriding legitimate grounds for the processing, or you object to the processing pursuant to
Art. 21 (2) GDPR. (4) The personal data concerning you has been processed unlawfully. (5) The erasure of the
personal data concerning you is necessary to fulfil a legal obligation under Union law or the law of the Member
States to which the controller is subject. (6) The personal data concerning you was collected in relation to
information society services offered pursuant to Art. 8 (1) GDPR.
b) Information to third parties
If the controller has made the personal data concerning you public and is obliged to erase it pursuant to
Art. 17 (1) GDPR, the controller shall take reasonable steps, including technical measures, taking into account
the available technology and the cost of implementation, to inform controllers processing the personal data that
you as the data subject have requested the erasure of all links to, or copies or replications of, this personal
data.
c) Exceptions
The right to erasure does not exist insofar as the processing is necessary (1) for exercising the right of
freedom of expression and information; (2) for compliance with a legal obligation which requires processing under
the law of the Union or the Member States to which the controller is subject, or for the performance of a task
carried out in the public interest or in the exercise of official authority vested in the controller; (3) for
reasons of public interest in the area of public health pursuant to Art. 9 (2) (h) and (i) and Art. 9 (3) GDPR;
(4) for archiving purposes in the public interest, scientific or historical research purposes or statistical
purposes pursuant to Art. 89 (1) GDPR, insofar as the right referred to in section a) is likely to render
impossible or seriously impair the achievement of the objectives of this processing, or (5) for the
establishment, exercise or defence of legal claims.
5. Right to notification
If you have asserted the right to rectification, erasure or restriction of processing against the controller,
the controller is obliged to notify all recipients to whom the personal data concerning you has been disclosed of
this rectification or erasure of the data or restriction of processing, unless this proves impossible or involves
disproportionate effort. You have the right against the controller to be informed about these recipients.
6. Right to data portability
You have the right to receive the personal data concerning you that you have provided to the controller in a
structured, commonly used and machine-readable format. You also have the right to transmit this data to another
controller without hindrance from the controller to which the personal data was provided, provided that (1) the
processing is based on consent pursuant to Art. 6 (1) (a) GDPR or Art. 9 (2) (a) GDPR or on a contract pursuant
to Art. 6 (1) (b) GDPR and (2) the processing is carried out by automated means. In exercising this right, you
also have the right to have the personal data concerning you transmitted directly from one controller to another,
where technically feasible. The freedoms and rights of other persons must not be adversely affected by this. The
right to data portability does not apply to processing of personal data necessary for the performance of a task
carried out in the public interest or in the exercise of official authority vested in the controller.
7. Right to object
You have the right to object at any time, on grounds relating to your particular situation, to the processing of
personal data concerning you which is based on Art. 6 (1) (e) or (f) GDPR; this also applies to profiling based
on these provisions. The controller will no longer process the personal data concerning you unless it can
demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms,
or the processing serves the establishment, exercise or defence of legal claims. If the personal data concerning
you is processed for direct marketing purposes, you have the right to object at any time to the processing of
personal data concerning you for such marketing; this also applies to profiling insofar as it is related to such
direct marketing. If you object to processing for direct marketing purposes, the personal data concerning you
will no longer be processed for these purposes. In connection with the use of information society services, and
notwithstanding Directive 2002/58/EC, you have the option of exercising your right to object by automated means
using technical specifications.
8. Right to withdraw consent under data protection law
You have the right to withdraw your declaration of consent under data protection law at any time. The withdrawal
of consent does not affect the lawfulness of processing carried out on the basis of the consent before its
withdrawal.
9. Automated individual decision-making, including profiling
You have the right not to be subject to a decision based solely on automated processing, including profiling,
which produces legal effects concerning you or similarly significantly affects you. This does not apply if the
decision (1) is necessary for entering into or performing a contract between you and the controller, (2) is
authorised by Union or Member State law to which the controller is subject and which also lays down suitable
measures to safeguard your rights and freedoms and legitimate interests, or (3) is based on your explicit consent.
However, these decisions must not be based on special categories of personal data pursuant to Art. 9 (1) GDPR,
unless Art. 9 (2) (a) or (g) applies and suitable measures to protect the rights and freedoms and your legitimate
interests have been taken. With regard to the cases referred to in (1) and (3), the controller shall take
suitable measures to safeguard the rights and freedoms and your legitimate interests, at least the right to
obtain human intervention on the part of the controller, to express your own point of view and to contest the
decision.
10. Right to lodge a complaint with a supervisory authority
Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a
supervisory authority, in particular in the Member State of your habitual residence, your place of work or the
place of the alleged infringement, if you consider that the processing of personal data concerning you infringes
the GDPR. The supervisory authority with which the complaint has been lodged shall inform the complainant of the
progress and the outcome of the complaint, including the possibility of a judicial remedy pursuant to Art. 78
GDPR.
